i'm not sure of the legal issues involving all of this, like others have said, maybe it's outlined in your 504 plan? I also don't know the age of your elementary school Lexi...but, bottom line, I suppose, is the safety of Lexi, if no one is going on the field trip, available to monitor her glucose, insulin, etc...that's what matters, no? not sure if it is indeed the school's responsibility to do this w/a nurse, is that how field trips went in the past...didn't you always attend them, is that the protocol or is it the responsibility of the school to provide that additional nurse on a school trip. This is not true. Type 1 diabetes is absolutely defined as a disability and the school is completely obligated to provide care while at school and for any extra-curricular activities afforded to other students. This would include field trips.
Not allowing her to go on the trip because the parents cannot go is completely and utterly against the law, unless this is a school that is 100% privately funded.
What happened at the follow up 504 meeting?
The Principal was reprimanded by the District. We have a plan that clearly states that we the parents are to be informed at least 2 weeks before a field trip, if no sub nurse is available and we will go with her.
It didnt help much. We are going to change districts. The sub nurse went home one day at 1pm, my daughter went in to get her shot, the secretary called us and said Lexi felt warm, and to come pick her up. They didnt want to deal with her, there was nothing wrong with her, they just didnt want to deal with her. Its discusting.
I’m sorry to hear there are still troubles. Call 1-800 diabetes for help. You should not have to change districts. I know from first hand experience how time consuming and emotionally draining dealing with something like this is. The ADA can and will help. What they are doing is wrong. They can be held accountable. Although a last resort, The Office of Civil Rights will ensure that they do.
