When FTC filed their report, Express Scripts sued them. Its the classic move whenever anybody says anything about the PBMs. Typically, this stuff gets tied up in court for years, but people are saying that doesn’t work this time around. You can smell blood in the water. That has everything to do with diabetic advocacy organizations (including Tu - where this stuff has been discussed for about a decade) and small pharmacy lobbying groups.
Part of the problem (that you all talked about 10 year ago in your explanation of why problems couldn’t be fixed) was the fact that there was no antitrust legislation in the US that remained. It had all been dismantled since the time of the rail barons. This was a difficult problem.
